Weed is not generally legal for recreational use in Benidorm. The same Spanish laws that apply elsewhere in Spain apply in Benidorm. Using or possessing cannabis in public can lead to an administrative fine, while supplying or trafficking it can be a criminal offence. Tourists are not exempt.
The position is often misunderstood because private personal use is treated differently from public use, and cannabis social clubs exist in a legally restricted area. This guide explains the practical rules for visitors without suggesting where or how to buy cannabis. For the national picture, read our guide to cannabis laws in Spain.
Is weed legal in Benidorm?
No. Benidorm has not legalised recreational cannabis. Spanish law distinguishes between conduct in private and conduct in public, but that does not create a general right to possess, smoke, grow or supply cannabis.
| Situation | What visitors should know |
|---|---|
| Smoking or possessing cannabis in public | A serious administrative offence under Spain’s Citizen Security Law. |
| Private personal use | Generally treated differently from public use, but it is not blanket legalisation and the facts still matter. |
| Selling, supplying or facilitating illegal use | Can be prosecuted under Spain’s Criminal Code. |
| Cannabis social clubs | Not ordinary licensed shops and not proof that recreational cannabis is legal. |
| Tourist status | Does not provide an exemption from Spanish law or local public-space rules. |
The clearest rule for a visitor is simple: do not assume that something is legal because it is visible, advertised or offered through a private association.
Can tourists smoke weed in Benidorm?
Tourists cannot legally smoke cannabis in Benidorm’s public places. Article 36.16 of Spain’s Organic Law 4/2015 on citizen security treats illicit use or possession of drugs in public places, public establishments and collective transport as a serious administrative offence. The rule also covers abandoning drug-related instruments in those places.
This applies whether a person is a resident or on holiday. A hotel balcony, rented apartment or club should not automatically be assumed to be a lawful place to consume cannabis: property rules, visibility from public space and the particular circumstances may all matter. Visitors should follow the accommodation’s rules and avoid exposing other people to smoke.
Public consumption and possession
Streets, squares, parks, public venues and public transport fall within the public-use rule. Possessing a small amount for personal use does not make public possession lawful. Spanish case law recognises a distinction between private personal possession and public conduct, but the public administrative offence remains in force.
Benidorm’s nightlife setting does not change the law. Smoking discreetly, carrying only a small quantity or saying that it is for personal use does not create a tourist exception. Police can seize the substance, and administrative proceedings may follow.
Beaches and other public spaces
Benidorm’s beaches are public spaces, so visitors should not smoke or possess cannabis on Levante, Poniente, Mal Pas or other publicly accessible beach areas. Benidorm City Council’s official Mal Pas beach service charter says beach behaviour must comply with the Valencian rules on drug dependence and the municipal beach ordinance. The council also publishes its current municipal regulations online.
The same cautious approach applies around promenades, car parks, nightlife areas and public transport. A quiet corner is still a public place.
What fines or penalties can apply?
Public use or possession under Article 36.16 is classified as a serious offence. Under Article 39 of the same law, serious offences carry a statutory fine range of €601 to €30,000. That is the national legal range, not a claim that every case receives the same fine. The amount and outcome depend on the legal procedure and circumstances.
More serious conduct is different. Article 368 of Spain’s Criminal Code covers cultivation, production or trafficking, and conduct that promotes, favours or facilitates illegal consumption. Those allegations can bring criminal consequences rather than an administrative fine.
Are cannabis social clubs legal in Benidorm?
Cannabis social clubs are not the same as licensed recreational cannabis shops. The existence of a registered association, a membership form or a private premises does not make every club activity lawful. Spanish courts assess what an organisation actually does, including how cannabis is cultivated, supplied and distributed.
Spain’s Supreme Court has said that organised, persistent cultivation and distribution by an association open to new members can amount to an offence under Article 368. In its summary of a cannabis-club judgment, the judiciary rejected the idea that a large club’s activity was protected simply as shared consumption.
What tourists should understand about cannabis clubs
- A club is not an ordinary retail shop or a guarantee of legality.
- Membership does not make public possession or smoking lawful.
- Online promotion or tourist-targeted advertising is not official approval.
- Rules stated by a promoter should not be treated as independent legal advice.
- Taking cannabis from private premises into a street, beach or other public place can expose a person to the public-possession rules.
This article does not recommend individual clubs or explain how to obtain cannabis. Visitors who need legal advice about a specific incident should consult a qualified Spanish lawyer.
Does Benidorm have different cannabis laws from the rest of Spain?
No separate Benidorm law makes recreational cannabis legal. Spain’s national Citizen Security Law and Criminal Code provide the main framework. Valencian and Benidorm rules can also govern conduct in beaches and other public areas, but they do not replace the national rules with a tourist-friendly exception.
Local policing and the facts of an incident affect how a rule is encountered in practice, but apparent tolerance should not be confused with legality. For a fuller explanation of private use, cultivation, CBD and the national framework, see Is Weed Legal in Spain?
